Terms of Service (Beta)

These Terms of Service (“Terms”) govern access to and use of the websites and applications available at geo-story.com, cumulativeeffects.com, and fielddms.app, including their subdomains (together, the “Services”), which are software platforms owned and operated by ProDelta Projects Inc. (“ProDelta,” “we,” “us,” or “our”). By accessing or using any of the Services, you (“User” or “you”) agree to be bound by these Terms. If you do not agree, do not access or use the Services.

The Services are currently in a private beta phase and are made available on an invitation-only basis to ProDelta personnel and approved beta testers. These Terms are a preliminary version prepared in advance of formal legal review and may be updated as the Services move toward general availability.

1. Beta Services

You acknowledge and agree that:

  • the Services are under active development and provided in “beta” form;
  • features, functionality, and data structures may change, be added to, or be removed without notice;
  • the Services may contain bugs, errors, or interruptions in availability;
  • access to any or all of the Services may be suspended, limited, or terminated at any time at ProDelta’s discretion.

2. Eligibility and Accounts

Access to the Services is limited to individuals authorized by ProDelta, including ProDelta personnel and approved beta testers. A single account may be used to access more than one Service, and authorization to use one Service does not by itself grant access to the others. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account, and must notify ProDelta promptly of any unauthorized use.

3. Permitted Use

You may use the Services solely for the purposes for which access was granted — including internal review, testing, and feedback on the Services — and in compliance with these Terms and applicable law. You must not:

  • attempt to access data, accounts, or content you have not been authorized to view;
  • copy, reverse-engineer, decompile, or attempt to derive the source code of any of the Services;
  • use the Services to build or assist in building a competing product;
  • share login credentials with unauthorized individuals;
  • disclose beta features, unreleased functionality, or other non-public aspects of the Services to third parties without ProDelta’s prior written consent;
  • introduce malicious code, or attempt to disrupt, overload, or gain unauthorized access to the Services.

4. Content

The Services are currently used to view, manage, and build materials, datasets, and geospatial content belonging to ProDelta (“Company Content”). All Company Content remains the property of ProDelta or its licensors and is made available to Users solely to facilitate testing and use of the Services. If a User uploads, submits, or generates content within the Services at ProDelta’s direction, ProDelta may use that content to operate, test, and improve the Services.

5. Feedback

Any feedback, suggestions, bug reports, or ideas you provide about the Services (“Feedback”) may be used by ProDelta without restriction or compensation to you. You assign to ProDelta all right, title, and interest in such Feedback.

6. Intellectual Property

The Services — including all software, design, text, graphics, and underlying technology — are owned by ProDelta or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the Services.

7. Confidentiality

The existence, features, and performance of the Services, and any non-public information you access through them, are confidential (“Confidential Information”) and must not be disclosed to any third party without ProDelta’s prior written consent, except as required by law.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. PRODELTA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, PARTICULARLY GIVEN THEIR BETA STATUS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODELTA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

ProDelta may suspend or terminate your access to any or all of the Services at any time, with or without cause or notice. Upon termination, your right to use the affected Services immediately ceases.

11. Changes to These Terms

ProDelta may revise these Terms at any time. Material changes will be communicated to active Users where practicable. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising from these Terms or the Services, regardless of the province from which you access them.
